Terms of Service

Article 1 (Applicability)

  1. These Terms of Service (hereinafter referred to as “these Terms”) set forth the conditions for using the smartphone application “Mainichi Patch” (hereinafter referred to as “the App”) provided by ComforTech (hereinafter referred to as “the Operator”).
  2. By using the App, users are deemed to have agreed to these Terms. If you do not agree to these Terms, please refrain from using the App.
  3. The App is primarily intended for use in vision training by preschoolers and children. If a user is a minor, they must obtain the consent of a parent or legal guardian before using the App. Furthermore, the downloading, initial setup, operation of the App, and agreement to these Terms shall be conducted by parents or legal guardians at their own responsibility.

Article 2 (Service Overview)

  1. The App provides tools to record and manage vision training (eye patch occlusion therapy) time and to support consistent training routines.
  2. Training records, calendars, graphs, and other data provided by the App are intended solely for self-management of training progress and do not guarantee vision improvement or medical treatment results.

Article 3 (Data Management & Disclaimer)

  1. Training data recorded in the App (recorded duration, selected eye, stamps, dates, etc.), custom photo stamp images, and settings are saved exclusively on the user’s device (local storage). The Operator does not transmit, synchronize, or back up this data to external servers.
  2. Users shall manage their own devices and in-app data at their own responsibility.
  3. If data is lost due to uninstallation of the App, device changes, loss, or malfunction, data restoration cannot be performed. The Operator assumes no responsibility for any damages incurred by users resulting from such data loss, except in cases of intentional misconduct or gross negligence by the Operator.

Article 4 (Fees)

Currently, all features of the App are available free of charge. No paid subscriptions are offered. The Operator may provide paid add-on content (such as stamps) in the future.

Article 5 (Prohibited Actions)

Users must not engage in any of the following actions when using the App:

  1. Actions that violate laws, court judgments, or public order and morals.
  2. Actions that infringe upon the intellectual property rights, privacy rights, or other rights of the Operator or third parties.
  3. Actions that place an excessive load on the App’s system or attempt unauthorized access.
  4. Actions to reverse engineer, decompile, or disassemble the App.
  5. Any other actions deemed inappropriate by the Operator.

Article 6 (Disclaimers)

  1. No Guarantee of Training Effects or Medical Advice: The App is not a medical device and does not provide medical diagnoses or advice. Please follow the instructions of an eye care professional (such as an ophthalmologist) regarding vision training and eye patch usage. The Operator makes no warranties regarding the training effects resulting from the use of the App.
  2. Accuracy of Data: The Operator does not warrant the accuracy, completeness, timeliness, or usefulness of the calculated time, graphs, or other data displayed in the App.
  3. Suspension or Interruption of Service: The Operator may temporarily suspend or interrupt the provision of the App without prior notice due to maintenance, system failures, or other unavoidable reasons. The Operator assumes no responsibility for any damages incurred by users as a result, except in cases of intentional misconduct or gross negligence by the Operator.

Article 7 (Handling of Information)

The Operator handles personal and user information appropriately in accordance with the separately established “Privacy Policy.” Users agree that the Operator handles information pursuant to the Privacy Policy.

Article 8 (Changes to Terms)

  1. The Operator may modify these Terms at any time at its discretion.
  2. When modifying these Terms, the Operator will notify users of the changes and the effective date within the App or on the relevant website.
  3. Continued use of the App by users after the effective date of the changes constitutes agreement to the modified Terms.

Article 9 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by and construed in accordance with the laws of Japan.
  2. Any disputes arising in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
